1. TERMS OF SERVICE

Effective from: 8 September 2026

These Terms of Service govern the use of everkeep.uk, the placing of orders and the distance sales contracts entered into through the online store.

In these Terms, EverKeep, we, us and our refer to MM Ecom Group Kft.

2. Definitions

Customer means any person who uses the Website or places an Order.

Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.

Product means a physical item offered for sale through the Website.

Order means a request submitted by a Customer to purchase one or more Products.

Contract means the sales contract formed between the Customer and us.

3. Applicable consumer law

Where we sell to consumers in the United Kingdom, mandatory UK consumer protection rules apply.

These include, where relevant:

  • the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
  • the Consumer Rights Act 2015;
  • the Digital Markets, Competition and Consumers Act 2024;
  • other applicable UK consumer protection legislation.

Nothing in these Terms excludes or restricts any statutory rights that cannot lawfully be excluded.

UK consumers buying goods online generally have a 14-day cancellation period.

4. Technical requirements

To use the Website you need:

  • internet access;
  • a compatible browser;
  • a valid email address when placing an Order.

Certain strictly necessary cookies may be required for the basket, checkout, security and other essential Website functions.

5. Products

EverKeep primarily sells:

  • journals;
  • memory books;
  • gift products;
  • related products.

The main characteristics of each Product are displayed on the relevant Product page.

Product images are provided for presentation purposes. Minor differences in colour may occur due to:

  • screen settings;
  • lighting;
  • printing processes;
  • materials used.

This does not affect your statutory rights where a Product is faulty or not as described.

6. Prices

Prices on everkeep.uk are displayed in pounds sterling, GBP.

The price shown to a UK consumer will include applicable taxes where required.

Before placing an Order, the Customer will be shown:

  • the price of the Products;
  • any applicable discount;
  • delivery charges;
  • any cash-on-delivery or payment fee, where applicable;
  • any other mandatory charge;
  • the total amount payable.

Mandatory fees must not be hidden and added only later in the purchasing journey. Current UK pricing rules prohibit drip pricing and require prices to be clear, complete and accurate.

7. Promotions and discounts

EverKeep may run promotions including:

  • Black Friday;
  • Mother’s Day;
  • Father’s Day;
  • Christmas;
  • Valentine’s Day;
  • seasonal promotions;
  • bundle offers;
  • multi-buy discounts;
  • discount codes;
  • free delivery;
  • gifts with purchase.

Where we use a previous or comparison price, percentage discount or similar savings claim, that claim must be genuine, clear and not misleading.

A higher comparison price must not be presented in a way that gives a misleading impression of the saving available.

For example, a price should not be presented as a temporary sale price where it has effectively become the normal selling price.

UK guidance specifically warns businesses against repeated or prolonged use of reference prices and false discount claims.

The name of a campaign, such as Black Friday or Mother’s Day Offer, does not necessarily mean that every benefit offered during that campaign is a percentage reduction from a previous price.

Promotions may instead include:

  • bundle pricing;
  • multi-buy offers;
  • free delivery;
  • gifts;
  • voucher codes;
  • spend-based offers.

The specific conditions of each promotion will be shown with the relevant offer.

8. Obvious pricing errors

If a Product is displayed at an obviously incorrect price due to a clear technical or administrative error, we may contact the Customer and explain the error.

Examples may include a Product displayed at £0, £0.01 or another clearly unrealistic price.

In this situation we may:

  1. inform the Customer of the mistake;
  2. provide the correct price;
  3. allow the Customer to proceed at the correct price;
  4. cancel the Order if the Customer does not accept;
  5. refund any payment already made for the cancelled Order.

9. Placing an Order

To place an Order, the Customer generally:

  1. selects a Product;
  2. adds it to the basket;
  3. selects the quantity or variation;
  4. reviews the basket;
  5. provides contact and delivery details;
  6. selects a delivery method;
  7. selects a payment method;
  8. reviews the total price;
  9. accepts the required terms;
  10. places the Order using a button clearly indicating an obligation to pay.

The Customer can correct entered information before submitting the Order.

10. Formation of the Contract

Submitting an Order is an offer by the Customer to purchase the selected Products.

After the Order is submitted, an automatic email may confirm that we have received it.

The Contract is formed when we accept the Order and send confirmation of acceptance.

If we cannot accept an Order, we will inform the Customer and refund any amount already paid for that Order.

11. Customer details

Customers must provide accurate and current information.

This may include:

  • full name;
  • delivery address;
  • email address;
  • telephone number;
  • billing information where required.

We are not responsible for delays caused solely by incorrect or incomplete information supplied by the Customer.

12. Payment methods

Available payment methods are displayed at checkout.

Card payment

Card payments may be processed through Shopify Payments.

PayPal

Where available, Customers may pay using PayPal.

Cash on Delivery

Where available for a particular delivery method, Customers may pay when the parcel is delivered.

An additional handling charge may apply to Cash on Delivery Orders.

The exact charge will be shown before the Order is placed.

Whether payment can be made by cash or card depends on the selected courier and delivery method.

13. Delivery

Order fulfilment is handled through Webshippy.

Available carriers and delivery methods are shown during checkout.

The exact delivery price will be shown before the Customer places the Order.

14. Estimated delivery time

Orders are usually prepared within:

1 to 3 working days.

After dispatch, delivery usually takes approximately:

2 to 4 working days.

The typical total estimated delivery time is therefore:

3 to 6 working days.

These are estimates and may be longer during periods of unusually high demand.

15. Product availability

If a Product becomes unavailable after an Order has been placed, we will inform the Customer.

If we are unable to fulfil the Order, any amount paid for the unavailable Product will be refunded.

16. Risk

For consumer sales, risk of loss or damage generally passes to the Consumer when the Consumer, or a person identified by them other than the carrier, takes physical possession of the goods.

17. Uncollected parcels

Failing to collect or accept a parcel does not automatically amount to a valid cancellation of the Contract.

A Consumer wishing to exercise their cancellation rights should clearly notify us.

If a properly dispatched parcel is returned because of circumstances attributable to the Customer, we may seek recovery of reasonable, actual and demonstrable costs where permitted by law.

We do not automatically charge a penalty simply because a parcel was not collected.

18. Statutory cancellation right

UK consumers purchasing goods online generally have the right to cancel the Contract within 14 days without giving a reason.

For goods, the cancellation period generally begins when the Consumer, or a person nominated by them other than the carrier, receives the goods.

Where multiple goods forming one Order are delivered separately, the period generally runs from receipt of the last item.

19. How to cancel

To exercise the statutory right to cancel, the Consumer must send us a clear statement.

The Consumer may use the model cancellation form, but this is not compulsory.

20. Returning Products after cancellation

After cancelling, the Consumer must send the goods back without undue delay and generally no later than 14 days after informing us of the cancellation.

The Consumer normally bears the direct cost of returning the Products unless we expressly agree otherwise.

21. Refund following statutory cancellation

Where a Consumer validly cancels the Contract, we will reimburse the payments due under applicable law.

This includes the standard delivery charge, subject to the applicable rules.

We may withhold reimbursement until:

  • we receive the goods back; or
  • the Consumer provides evidence that the goods have been sent back,

whichever occurs first.

The Consumer Contracts Regulations provide for reimbursement including the basic delivery cost, but not additional delivery costs caused by choosing a more expensive delivery option.

22. Handling of returned Products

The Consumer may handle a Product only to the extent reasonably necessary to establish its nature, characteristics and functioning.

The Consumer may be responsible for any reduction in value caused by handling beyond that level.

23. Personalised Products

The statutory cancellation right may not apply to Products made to the Consumer’s specifications or clearly personalised for them where the legal exception applies.

For example, a journal individually produced with:

  • a requested name;
  • personal wording;
  • a photograph;
  • another bespoke design

may fall within this exception.

A standard pre-made EverKeep journal does not become personalised merely because it was purchased as a gift.

24. Voluntary 30-day returns

In addition to the statutory cancellation period, EverKeep voluntarily offers eligible Products a 30-day return period from the date of receipt.

Between day 15 and day 30, the Product must generally:

  • be unused;
  • be undamaged;
  • not have been written in;
  • not have been completed;
  • remain suitable for resale.

This additional return promise does not restrict statutory consumer rights.

25. Faulty or non-conforming goods

Under UK consumer law, goods must be:

  • as described;
  • of satisfactory quality;
  • fit for purpose.

If a Product fails to meet the applicable legal standards, Consumers may have statutory remedies including repair, replacement, price reduction or rejection of the goods, depending on the circumstances.

These rights are separate from the statutory cancellation right and our voluntary 30-day return policy.

26. Complaints

Complaints may be submitted to:

info@everkeep.uk

We recommend including:

  • name;
  • Order number;
  • relevant Product;
  • description of the issue;
  • photographs where helpful.

We will deal with complaints in accordance with applicable law.

27. Customer reviews

We may display customer reviews on the Website.

If a review is labelled Verified Purchase or similar, we will use a reasonable process intended to verify that the reviewer purchased the relevant Product.

We do not knowingly publish or commission fake consumer reviews.

28. Intellectual property

Content on everkeep.uk, including:

  • photographs;
  • written content;
  • journal designs;
  • graphics;
  • videos;
  • illustrations;
  • logos;
  • marketing materials

may be protected by copyright, trade mark or other intellectual property rights.

Unauthorised commercial copying, reproduction, distribution or modification is prohibited.

29. Privacy

Personal data is handled in accordance with our Privacy Policy.

Cookies and tracking technologies are dealt with in our cookie consent system and relevant privacy information.

30. Governing law and consumer rights

MM Ecom Group Kft. is incorporated in Hungary.

Nothing in these Terms prevents a UK Consumer from benefiting from mandatory protections available under UK consumer law where those protections apply.

31. Changes to these Terms

We may update these Terms for future Orders where necessary due to changes in:

  • law;
  • payment methods;
  • delivery services;
  • technology;
  • store operations;
  • Products or services.

Orders already placed remain subject to the version applicable when the Order was made.
